These Terms of Service (“Terms”) govern your access to and use of the websites, forms, phone/text communications, and related online services provided by National Disaster Response (“NDR,” “we,” “us,” or “our”). By accessing or using our website or interacting with our online services, you agree to these Terms.
If you do not agree, do not use our website or online services.
1) Who We Are
National Disaster Response provides disaster restoration and related services, which may include water damage restoration, mold remediation, fire/smoke cleanup, and other property restoration services.
2) Eligibility
You must be at least 18 years old to use our website and request services online. By using our site, you represent that you meet this requirement.
3) Website Use and Acceptable Conduct
You agree not to:
- Use the website in any way that violates laws or regulations
- Attempt to gain unauthorized access to systems or data
- Interfere with site performance (e.g., malware, scraping, denial of service)
- Submit false, misleading, or impersonated information
- Use the website to transmit unlawful, infringing, or harmful content
We may suspend or restrict access if we believe your use violates these Terms.
4) Service Requests, Estimates, and Scheduling
A. Requests are not a guarantee of service
Submitting a form, calling, or texting NDR is a request for information or scheduling—it does not guarantee availability, pricing, timing, or that services will be performed.
B. Estimates
Any estimate provided is based on information available at the time and may change after inspection, scope confirmation, testing results, access limitations, or hidden conditions.
C. Scheduling and access
You are responsible for providing accurate contact details and reasonable access to the property for inspection and service.
D. Emergency conditions
If there is an active emergency (e.g., fire, gas leak, medical emergency), call 911 first.
5) Insurance and Third-Party Claims
If insurance is involved, call us first so we can document and help you navigate the claim. We do not promise or guarantee coverage, payment, claim approval, or timelines. You remain responsible for your policy obligations, deductibles, and any amounts not covered by insurance.
6) Payments and Billing
If you engage NDR for services, you agree to pay amounts due according to the written scope, work authorization, invoice, or other documentation provided to you.
- Payment terms may vary by job, scope, and insurance involvement.
- Late payments may result in paused work or collections as permitted by law.
- If a third-party payment processor is used, its terms and privacy practices also apply.
7) SMS/Text Messaging and Phone Communications
By providing your phone number and opting in, you agree that NDR may contact you by phone call and SMS for service-related communications including scheduling, confirmations, dispatch updates, job status, documentation, and follow-ups.
- Opt-out: Reply STOP to unsubscribe from SMS messages.
- Help: Reply HELP for help.
- Message frequency varies. Message and data rates may apply.
You understand that consent to receive SMS is not a condition of purchasing services.
8) User Content (Forms, Photos, Messages)
You may submit information, photos, or other content (“User Content”) through our forms or communications. You grant NDR a non-exclusive right to use User Content as reasonably necessary to:
- Evaluate and perform requested services
- Communicate with you
- Maintain records for quality, documentation, and compliance
You represent that you have the right to submit the content and that it does not violate law or third-party rights.
9) Intellectual Property
Our website content, branding, logos, text, graphics, photos, and design are owned by NDR or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without written permission, except for normal personal viewing.
10) Third-Party Services and Links
Our website may include links or integrations with third-party services (such as analytics, pixels, scheduling tools, or payment providers). We do not control those third parties and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.
11) Disclaimers
A. Website informational purpose
Website content is provided for general informational purposes and does not constitute professional advice, engineering advice, legal advice, or guarantees of outcomes.
B. No warranties
To the fullest extent permitted by law, the website and online services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
12) Limitation of Liability
To the fullest extent permitted by law, NDR and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the website or online services.
To the fullest extent permitted by law, NDR’s total liability for any claim related to the website or online services will not exceed $100.
Some states do not allow certain limitations, so these limits may not apply to you.
13) Indemnification
You agree to defend, indemnify, and hold harmless NDR from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the website, or your infringement of any rights of another person or entity.
14) Termination
We may suspend or terminate your access to the website at any time if we believe you violated these Terms or if we discontinue the website or online services.
15) Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date reflects the most recent revision. Continued use after changes means you accept the updated Terms.
16) Governing Law and Venue
These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any dispute arising from these Terms will be brought in the state or federal courts located in Utah County, Utah, and you consent to their jurisdiction, except where prohibited by law.
17) Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
18) Carrier Disclaimer (SMS/MMS)
Carriers are not liable for delayed or undelivered messages. Mobile carriers (including, but not limited to, AT&T, Verizon, T-Mobile, and their affiliates) are not responsible for SMS/MMS messages sent to or from National Disaster Response (NDR), including any message delivery failures, delays, misrouting, or message content.
